The end of the era of CBD vapes and sweet e-cigarettes: What does the new decree bring?

What actually happened?
On December 1, 2025, Decree No. 429/2025 Coll., amending the existing Decree No. 37/2017 Coll. on electronic cigarettes, their refill liquids, and herbal products for smoking, came into effect. This amendment brings some of the biggest changes to vaping regulation in the history of the Czech Republic.
The changes primarily concern two areas:
- Ban on cannabinoids (including CBD) in liquid refills for e-cigarettes
- Ban on sweet and confectionery flavors
Cannabinoids in e-cigarettes? The end.
The amendment explicitly prohibits the use of cannabinoids and their derivatives in the production of liquid refills for electronic cigarettes. The ban applies to all cannabinoids without exception:
- CBD (cannabidiol)
- HHC (hexahydrocannabinol) and its derivatives
- CBG (cannabigerol)
- CBN (cannabinol)
- All synthetic and semi-synthetic cannabinoids
Manufacturers had to immediately stop producing new products with these substances. Products manufactured before December 1, 2025 could be sold until June 30, 2026. After this date, an absolute ban on sales applies.
Farewell, sweet flavors
In addition to cannabinoids, the amendment also prohibits ingredients that give e-cigarettes a sweet, confectionery, or dessert taste and aroma. Specifically, this means the end for flavors such as:
- 🍬 Bubble gum, cotton candy
- 🥤 Cola, lemonade, energy drinks
- 🍰 Desserts, cakes, tarts
- Any "fantasy" sweet flavors
Only clearly defined characteristic flavors — such as tobacco, menthol, or fruit that meet strict criteria — remain permitted.

CBD under pressure even outside vaping
The pressure on CBD is not just coming from the e-cigarette sector. The Czech government is discussing including CBD on the list of so-called psychomodulatory substances, which would mean:
- Sales only in specialized brick-and-mortar stores
- Only to persons over 18 years of age
- Necessity of a license for sellers (in the order of hundreds of thousands of crowns annually)
- Advertising ban and marketing promotion
The Czech Hemp Cluster and many experts criticize these measures. CBD is not a psychoactive substance – unlike THC, it does not affect consciousness. It is used by athletes for recovery, seniors for various ailments, or people looking for an alternative to common dietary supplements.
Why are these changes happening?
The Ministry of Health justifies the steps primarily by the protection of children and adolescents. The statistics are indeed alarming:
- E-cigarettes were used by almost 14% of the Czech population in 2024
- Over the last five years, the proportion of users has almost tripled
- Among young people aged 15-24, more than a quarter use e-cigarettes
The World Health Organization (WHO) points out that e-cigarettes are not an effective tool for quitting smoking and can have adverse health effects.
What does this mean for the market?
For retailers, manufacturers, and distributors, this is a fundamental change. Companies that built their business on CBD vapes or sweet flavors must quickly re-evaluate their product range. Penalties for violating the rules are threatened by the State Agricultural and Food Inspection (SZPI) and the Czech Trade Inspection (ČOI).
Conclusion
The regulation of vaping and CBD products in the Czech Republic is significantly tightening. Whether you are a retailer, manufacturer, or consumer – it is important to know the current rules and adapt to them in time. A key date to remember: July 1, 2026 – from this date, the new rules apply in full.
